《与贸易有关的知识产权协议》(TRIPS协议)是对地理标志国际保护的最新国际公约。其设定的一般保护原则及例外规定,对完善各成员的地理标志保护制度,协调成员立法具有重要的指导意义。我国新修定的《商标法》及其《实施细则》增加了对地理标志进行保护的内容,初步建立了我国的地理标志法律保护制度。但是,我国法律对地理标志的内涵及认定标准,保护范围,管理模式等内容尚缺乏统一完善的规定;对地名商标与地理标志关系的界定也很模糊。我国已经加入WTO,建立与国际规则相适应的地理标志法律保护体系势在必行。
The TRIPS Agreement is the latest international convention on the international protection of geographical indications. The general principles of protection and the exceptions stipulated therein have important guiding significance for perfecting the system of protecting geographical indications and coordinating members’ legislation. The newly revised Trademark Law and its Implementing Rules in our country have added the content of protecting geographical indications and initially established the legal protection system of geographical indications in our country. However, the law of our country lacks the unified and perfect provisions for the connotation of geographical indications and the standards, the scope of protection and the mode of management. The definition of the relationship between geographical names and geographical names is also very vague. China has acceded to the WTO and it is imperative to establish a legal protection system of geographical indications that is compatible with international rules.
