文章针对宪法学界关于我国宪法性法律几个颇具争议的问题进行探讨,并认为:应对成文宪法和不成文宪法国家的宪法性法律概念进行区分;宪法性法律不应成为我国宪法的渊源;宪法性法律和宪法典不应同属于同一法律部门。
The article probes into several controversial issues about constitutional law in our country, and holds the view that the constitutional legal concepts of written constitution and unwritten constitutional state should be distinguished; the constitutional law should not be the origin of our constitution; the constitutionality The law and the constitution should not belong to the same legal department.
