美国,可以说是一个由新老移民组成的国家。移民法律对美国说来,从来是重要的法律。1986年11月美国第99届国会通过的新移民法律,即移民改革和管制法(Immigration Reformand Control Act),移民婚姻诈欺修正案(Immigration Marriage Fraud Amend-ments of 1986),移民和入籍法修正案(Immigration and Naturalization ActAmendments of 1986),是具有重要意义的。它对1952年制定的美国移民法(全称为移民和国籍法Immigration and Nationality Act,简称INA)做了重大修改。这次修改是继1921年“移民配额案”和1952年“麦卡伦——华特案”以来最具有变革性的修改,是美国移民法发展史上的新里程碑。因此,对经1986年变革后的美国移民法进行剖析,并联系美国移民政策和法律的变迁作一番考察和研究,是深入认识美国移民法的现状所十分必要的。
The United States can be said to be a country made up of old and new immigrants. Immigration laws have always been important laws for the United States. The Immigration Marriage Fraud Amendments (1986), Immigration and Citizenship Amendments, passed the Immigration Reformand Control Act of November 1986 by the 99th National Assembly of the United States, The Immigration and Naturalization Act Amendments of 1986 is of great significance. It made major changes to the U.S. immigration law (full name Immigration and Nationality Act, INA) enacted in 1952. This revision is the most transformative revision since the immigration quotas in 1921 and the McCarran-Walt case in 1952. It is a new milestone in the history of the U.S. immigration law. Therefore, analyzing the American immigration law after the change in 1986 and making some investigations and studies in connection with the changes of U.S. immigration policies and laws is necessary to get a deep understanding of the status quo of the U.S. immigration law.
