作为哲学解释学的重要范畴,“前理解”在刑法解释学中也具有重要的影响和价值。作为刑法解释的起点,“前理解”由特定解释者的刑法文化、刑法思维和刑法背景知识组成。“前理解”对刑法解释具有潜在、间接的影响,特别是特定解释者的“前理解”中包含了大量不利于刑法解释的负面因素;特定解释者的偏见、误解、情绪、错觉等都会在一定程度上影响其对刑法问题和刑法规范的理性认识。在进行刑法解释的过程中应综合考量解释结论的合法性与合理性,从制度设计上规范刑法解释,以便合理控制解释者“前理解”之负面因素给刑法解释带来的消极影响。
As an important category of philosophical hermeneutics, “pre-understanding” also has important influence and value in criminal law hermeneutics. As a starting point for the interpretation of criminal law, “pre-understanding ” consists of the specific interpreter’s criminal law culture, criminal law thinking and criminal law background. “Pre-understanding ” has a potential and indirect impact on the interpretation of criminal law, especially the “pre-understanding” of a specific interpreter contains a large number of negative factors that are not conducive to the interpretation of criminal law; prejudice, misunderstanding, emotion, Illusion and so on will to some extent affect its rational understanding of the criminal law and criminal law norms. In the process of interpretation of criminal law, the legitimacy and rationality of interpretation conclusion should be comprehensively considered, and the interpretation of criminal law should be regulated from the perspective of system design in order to reasonably control the negative influence of the negative factors of interpreter ’s former understanding on the interpretation of criminal law.
